Welcome to the British Friendly Society ("the Society") website (the "Site"). The terms, covenants, conditions and provisions (the "Terms of Use") are the entire agreement between you and the Society for your use of and access to the Site.

1. By accessing, viewing or using the materials or services available o­n or through the Site you agree to be legally bound by the Terms of Use.
2. British friendly Society may change the Terms of Use at any time by posting changes o­nline. Please review these terms regularly to ensure you are aware of any changes. Your continued use of the Site after changes are posted means you agree to be legally bound by these terms as updated and/or amended.

Use of the Site

3. All copyrights and other intellectual property rights in the artwork, graphics, text, video and audio clips, trade marks, logos and other content available o­n the Site (the "Content") are owned or used with permission by British friendly Society.
4. Nothing contained in these Terms of Use shall be construed as conferring by implication, estoppel or otherwise any licence or right to use any trademark, patent, design right or copyright of British friendly Society or any other third party.
5. You may not copy, reproduce, republish, download, post, broadcast, transmit, modify, distribute or otherwise use the Content in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work, including your own website, from any Content except for your own personal, non-commercial use. Any other use of the Content requires the prior written permission of British friendly Society.
6. You agree to use the Site o­nly for lawful purposes, in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the Site, is not offensive or abusive and does not violate the rights of third parties or inhibits others from using and enjoying this Site. Prohibited behaviour includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of dialogue within the Site.
7. You may not monitor or copy the Content by using any robot, "bot", spider, crawler or other automatic device or manual process, without British friendly Society' written permission, or engage in any activity which interferes with the proper working of the Site. You agree to indemnify, defend and hold harmless British friendly Society and its subsidiaries, affiliates, officers and employees from any damages, liabilities and expenses (including reasonable legal fees) arising from any third party claims resulting from, or arising out of, your use of the Site. British friendly Society reserves the right to terminate your access to the Site at any time, without notice, for any reason whatsoever.

Disclaimers and Limitation of Liability

8. Site content, including the information, names, images, pictures, logos and icons regarding or relating to British friendly Society, its products, functions and services (or to third party products and services), is to the extent permitted by law provided "AS IS" without any representations or any kind of warranty made (whether express or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. In particular, there is no warranty against interference with your enjoyment of the information o­n the Site or that the Site, the information contained in it or our efforts will fulfil any of your particular purposes or needs.
9. Neither British friendly Society nor anyone who helped develop, create, produce or deliver the Content is liable for any damages, including indirect or consequential damages, related to your use of or inability to use the Site, even if advised of other miscellaneous damages and expenses, such as incidental, special or punitive damages. The exclusions above will not cover our liability for death or personal injury, our liability for a breach of statutory or contractual duties or loss caused by our fraud.
10. British friendly Society uses reasonable efforts to ensure that accurate information is provided o­n this Site, but does not guarantee such accuracy, and makes no representations or warranties regarding the use or results of use of any Consent o­n this Site in terms of its accuracy, reliability or any other matter.
11. The Society does not warrant that functions contained in the Site will be uninterrupted or error free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or bugs.
12. Although this Site may refer to products or services of third parties or link to third party sites or information, British friendly Society does not endorse or make any warranties or representations about them. Any links to other sites are provided for your convenience o­nly.

You need to make your own decisions regarding third party products, services and websites.

Contributions to the Site

13. Where you submit any contribution to the Site (including any text, photograph, graphics, video or audio) you agree that that contribution is automatically deemed to be either the property of British friendly Society or can be used by it and that British friendly Society can use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, broadcast it here or somewhere else and exercise all copyright and publicity rights with respect to that contribution and/or to incorporate your contribution in other works in any media now known or later developed. Under no circumstances are you entitled to any payment if British friendly Society uses any contribution.
14. By submitting a contribution to the Site, you:
    • warrant that your contribution:
      • is your own original work and that you have the right to make it available to British friendly Society for all the purposes specified above;
      • is not defamatory; and
      • does not infringe any law;
    • indemnify British friendly Society against all legal fees, damages and other expenses that may be incurred by British friendly Society as a result of your breach of the above warranty; and
    • waive any moral rights in your contribution for the purposes of its submission to and publication o­n the Site and the purposes specified above.

House rules for Site Communities

15. You agree to use the Site Communities (the "Site Communities") (including Message Boards) in accordance with the following house rules:

    About your posts:

    • Contributions must be civil and tasteful;
    • No rude or abusive behaviour (flaming or trolling) - postings must be constructive and polite, not mean-spirited or posted with the intention of causing trouble;
    • Unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable;
    • Be patient - users of all ages and abilities may be taking part in the relevant Site Community;
    • No spamming - don't cross post your messages to more than o­ne discussion;
    • No advertising;
    • Posts containing languages other than English may be removed unless allowed in the local house rules;
    • No impersonation. Adopting an inappropriate user name (one that is vulgar, offensive, etc.) is also unacceptable;
    • You may not post your email address unless allowed under the local house rules;
    • You may not refer to specific URLs (website addresses) unless allowed under the local house rules. If you know of a worthy website relevant to the discussion topic, please go to the Web Guide and recommend it by email if it's not already listed.

    About the law:

    • You may not post any defamatory or illegal material of any nature in the Site Communities. This includes text, graphics, video, programs or audio. Posting a message with the intention of committing an illegal act is strictly prohibited.
    • You agree to o­nly post materials to which you have the copyright or other permission to distribute electronically. You may not violate, plagiarise, or infringe o­n the rights of third parties including copyright, trade mark, trade secrets, privacy, publicity, personal or proprietary rights.

    If you're under 16:

    • Please get your parents' permission before taking part in any discussion.
    • Never reveal any personal information about yourself (for example, your telephone number, home address or email address).

    If you breach these Terms of Use:

    • If you fail to abide by these Terms of Use (including the house rules at this paragraph 15 above), you may be prohibited from using the Site Communities for an extended period of time.
    • British friendly Society may use whatever information that is available to it about you to stop any further breach of the Terms of Use. This can include informing relevant third parties such as your employer or email provider about the infringement/s.
    • British friendly Society reserves the right to delete any posting, at any time, for any reason.

General

16. If there is any conflict between these terms and specific terms appearing elsewhere o­n the Site (including local house rules) then the latter shall prevail.
17. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.
18. These terms shall be governed by and interpreted in accordance with the laws of England and Wales and are subject to the exclusive jurisdiction of the English courts.
